Terms of Service - FrameSync Labs

Please read these Terms of Service ("Terms") carefully before booking any services from FrameSync Labs. By accessing our website or booking a session, you agree to be bound by these Terms.

About Us

FrameSync Labs is the trading name of FRAMESYNC LABS SP. Z O.O. We offer remote PC optimization services tailored to gaming performance.

Services

Our services include scheduled remote optimization sessions, during which we access and adjust system settings on your PC to improve gaming, and overall performance. All services are delivered remotely via secure screen-sharing software.

Quick Evaluation

Quick Evaluation is a separate 15-minute advisory session priced at 5 EUR. During it we assess whether your system is a suitable candidate for optimization; we do not change any settings on your PC. If you subsequently book an optimization plan, the 5 EUR you paid is deducted from the price of that plan. The deduction applies to one booking only, is not transferable, and is not redeemable for cash. Because the evaluation is a service performed at a scheduled time, the cancellation, rescheduling and withdrawal provisions below apply to it, with two exceptions: the Performance Guarantee does not apply, as no optimization is carried out; and we supply none of the digital materials described below for an evaluation, so if you cancel before it begins you receive a full refund and no cancellation fee applies.

Booking and Payment

All services must be booked in advance through our website. Full payment is required at the time of booking to confirm your session.

Cancellations, Rescheduling, and Refunds

• We work around our customers' schedules, therefore rescheduling is free forever. If a time or date doesn't suit you - please feel free to contact us and we'll reschedule your session at no extra cost.
• Cancellations before the session begins are subject to a 20% fee once we have supplied you with the digital materials for your optimization session - the pre-optimization instructions, the utilities folder containing the tools used for your optimization, and access to our custom operating system (FSOS-X). These materials are supplied for optimization plans only, not for a Quick Evaluation. This fee is consideration for that digital content, which is delivered to you immediately and cannot be returned. If you have received none of those materials, a full refund will be issued.
• Due to the nature of this service, refunds will not be issued after the service has been delivered or substantially performed, except as set out in our Performance Guarantee below. You also receive 30 days of priority support after the session to help fix any issues you might be having.

Performance Guarantee

We stand behind our work. If our optimization produces no measurable performance improvement on your system (<=5% MoE based on average FPS and 1% lows, or synethetic benchmark results where suitable) - as confirmed by the before (stock) and after (optimized) benchmarks and stability tests carried out during your session - you are entitled to a full refund, even after the service has been delivered. This guarantee covers only the complete absence of a measurable performance gain. It does not apply where a performance increase is achieved but is smaller than you expected, nor to limitations caused by your hardware, pre-existing hardware or software issues, or your system's specifications. It is also void if you have changed, reverted, or otherwise tampered with any of the optimization settings applied during your session, in the same way this voids your warranty (see Customer Responsibilities). To claim under this guarantee, you must raise the matter during your session or within 30 days of it, and your claim will be assessed using the same benchmarking methodology used during the session.

Right of Withdrawal

If you are a consumer resident in the EU or EEA, you have a statutory right to withdraw from a distance contract within 14 days of entering into it, without giving a reason. Because our sessions are scheduled at your request, and because we supply digital materials in advance for our optimization plans, that right is affected as set out below.

• Before payment you must tick a box confirming that you accept these Terms; a booking cannot be completed without it. By accepting them you accept this section, which means you ask us to begin performing the service and to supply the materials below before the end of the 14-day withdrawal period, and you accept that your right of withdrawal ends once the service has been fully performed.
• Ahead of an optimization session we supply digital content: the pre-optimization instructions, the utilities folder containing the tools used for your optimization, and access to our custom operating system (FSOS-X). By requesting your session you consent to that digital content being supplied immediately, and you acknowledge that you lose your right of withdrawal in respect of it once supply has begun. No digital content is supplied for a Quick Evaluation, so this paragraph does not apply to one.
• If you withdraw after your session has begun but before it has been fully performed, you must pay an amount proportionate to what has already been provided to you, measured against the full price of the contract.
• If you have received none of the digital materials above and your session has not begun, you may withdraw within 14 days and receive a full refund.

The 20% cancellation fee described above applies only where those digital materials have already been supplied to you, and represents payment for that content rather than a penalty.

To withdraw, email us at [email protected] with your booking details before your session begins. This section does not affect your rights under the Performance Guarantee above.

Customer Responsibilities

By booking our service, you agree to:

• Provide a fully functional PC and stable internet connection.
• Be available at the scheduled time and respond to technician instructions.
• Be patient during the optimization process and the stability testing phase.
• Not change any settings during your specified warranty period (30 days), otherwise your warranty will be void.

You retain full control and can end the session at any time or ask questions if something is unclear to you. All of our engineers are fully vetted and trained to work with thousands of different hardware combinations.

Intellectual Property

Any tools, scripts, processes, or configurations used during your session remain the intellectual property of FrameSync Labs. You may not copy, share, or reproduce them without permission.

Limitation of Liability

Our optimizations are carried out by trained engineers, are tested before use, and are designed to be safe and reversible. We will provide support, but we will not be held liable for:

• Issues arising from pre-existing hardware or software problems.
• Performance limitations due to your system specifications.
• Bad game patches/updates in the future that decrease performance.

Our liability is limited to the amount paid for the booked session. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded, and nothing in them affects your statutory rights as a consumer.

Refusal of Service

We reserve the right to refuse or cancel a session at our discretion if:

• We detect unsafe, abusive, or suspicious behavior towards our engineer.
• The customer fails to provide access or participate.
• The system is not suitable for optimization.

In such cases, we may offer a full or partial refund (for limited system) or terminate your session if a violation is detected.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of Poland. If you are a consumer resident in the EU or EEA, this choice does not deprive you of the protection of any mandatory consumer-law provisions of your own country of residence.
